Terms of Service

Effective Date: 1 January 2026

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and Tumit Limited ("we", "us") governing your use of the Sherehe Mezani platform ("Platform"), in accordance with the Law of Contract Act (Cap 23) and Consumer Protection Act, 2012 of Kenya.

By accessing the Platform, submitting an RSVP, or purchasing a ticket, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately cease using the Platform.

2. Platform Description

Sherehe Mezani is an online event discovery and RSVP platform operated by Tumit Limited. We act as an intermediary between event organisers ("Organisers") and event attendees. We do not organise, host, or take responsibility for any events listed on the Platform. All event details — including dates, venues, pricing, and activities — are provided solely by the respective Organisers.

3. Eligibility

You must be at least 18 years of age to use the Platform and to submit an RSVP or purchase a ticket. By using the Platform you represent and warrant that you meet this requirement. We reserve the right to cancel any RSVP submitted by a person found to be under the age of 18.

4. RSVP and Ticket Purchases

When you submit an RSVP on the Platform you agree to the following:

  • All information provided (name, phone, email, M-Pesa transaction code) must be accurate and truthful. Submission of false information may result in denial of entry and forfeiture of payment without refund.
  • An RSVP constitutes an offer to attend the event subject to payment verification. Your RSVP is only confirmed once your M-Pesa payment has been verified by us or the Organiser.
  • Your ticket will be delivered to the email address you provide. We are not liable for non-delivery caused by an incorrect email address provided by you.
  • Tickets are personal and non-transferable unless the Organiser expressly permits transfer.
  • We reserve the right to cancel RSVPs or tickets that are fraudulently obtained.

5. Payment Terms

All payments are processed via M-Pesa. By submitting an M-Pesa transaction code you confirm that:

  • The transaction was made by you or with your express authorisation.
  • The transaction code is valid and corresponds to a genuine M-Pesa payment of the correct amount to the correct Paybill and account number.
  • You accept that payment verification may take up to 24 hours.
  • Submission of a fraudulent, duplicate, or incorrect transaction code constitutes a breach of these Terms and may result in legal action under the Computer Misuse and Cybercrimes Act, 2018 and the Penal Code (Cap 63) of Kenya.

6. Refund and Cancellation Policy

All ticket sales are final. We do not offer refunds except in the following circumstances:

  • The event is cancelled by the Organiser and no substitute date is offered. In such cases, refund requests must be submitted to the Organiser directly within 14 days of the cancellation notice.
  • A verified duplicate payment was made in error and confirmed by our records.

We are not responsible for refunds arising from event postponement, venue changes, or changes in event content made by the Organiser. In the event of a dispute, your rights under the Consumer Protection Act, 2012 (Kenya) remain unaffected.

7. Event Organiser Responsibility

Events listed on the Platform are organised and managed by independent third-party Organisers. We do not control, endorse, or take responsibility for:

  • The accuracy of event descriptions, dates, venues, or pricing
  • The quality, safety, or conduct of any event
  • Any harm, injury, loss, or damage suffered at or in connection with any event
  • Cancellation, postponement, or changes to any event

Your attendance at any event is entirely at your own risk.

8. Limitation of Liability

To the maximum extent permitted by Kenyan law, Tumit Limited shall not be liable for:

  • Any indirect, incidental, special, or consequential loss or damage arising from your use of the Platform
  • Loss of profits, data, goodwill, or business opportunity
  • Any act or omission of an Organiser
  • Platform downtime, technical errors, or third-party service failures

Our total aggregate liability to you for any claim arising out of or in connection with the Platform shall not exceed the amount paid by you for the specific ticket or RSVP giving rise to the claim.

9. User Obligations

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of Kenyan law
  • Submit false, misleading, or fraudulent information
  • Resell tickets obtained through the Platform without the Organiser's written consent
  • Attempt to gain unauthorised access to the Platform or its systems
  • Upload or transmit any harmful, defamatory, or infringing content

Breach of these obligations may result in immediate suspension of your access and, where appropriate, referral to law enforcement authorities.

10. Intellectual Property

All content on the Platform, including the Sherehe Mezani name, logo, design, and software, is the exclusive property of Tumit Limited and is protected under Kenyan and international intellectual property laws. You may not reproduce, distribute, or create derivative works from any Platform content without our prior written consent.

11. Indemnity

You agree to indemnify, defend, and hold harmless Tumit Limited, its directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or in connection with your use of the Platform, your breach of these Terms, or your attendance at any event.

12. Modifications to Terms

We reserve the right to amend these Terms at any time. Updated Terms will be posted on the Platform with a revised effective date. Your continued use of the Platform after such changes constitutes your acceptance of the amended Terms.

13. Dispute Resolution

Any dispute arising out of or in connection with these Terms shall first be referred to good-faith negotiation between the parties. If unresolved within 30 days, the dispute shall be referred to mediation in Nairobi, Kenya. If mediation fails, the dispute shall be submitted to the exclusive jurisdiction of the courts of Kenya.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. The United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
